Haikou introduced real estate regulation rules: purchase restriction in main urban areas and ecological protection areas

The reporter learned from Haikou municipal government on May 9 that according to the notice on restricting the purchase of multiple commercial houses jointly issued by three departments of Hainan province (Qiong Jianfang [2017] No. 96) (Hereinafter referred to as “notice No. 96”) requirements, recently, haikou municipal people’s government promulgated the “detailed rules for the implementation of the notice of Haikou Municipal People’s Government on restricting the purchase of multiple sets of commercial houses” (hereinafter referred to as the detailed rules), it mainly puts forward the implementation rules for Haikou real estate regulation from eight aspects.

First, the scope of purchase restriction has been further clarified. Property-based hotels and second-hand housing will be included in the scope of this purchase restriction.

The second is to set up purchase restriction areas in Haikou city. The first is the main urban area, west of Binjiang West Road, east of Changtong Road, South China Sea Avenue and north of Hongcheng Lake; The second is the southern ecological protection zone, which is mainly south of cocosea Avenue, north of the ring-around Expressway, it is an important ecological protective belt of Haikou in accordance with the integration of multiple rules to the west of the road and the east of Yuehai Avenue.

Third, strictly define the qualification of house purchase. The first is to impose a restriction on the purchase of non-registered residents in this province. Non-registered residents who do not own commercial houses or property rights hotels in Hainan can apply for the first purchase in the non-restricted purchase area; the second is to require non-registered residents in this province to provide social security certificates for more than 2 consecutive years in all cities and counties in our province before purchasing the first suite in the restricted area.

The fourth is to increase the operating ratio of property-based hotels. The sales proportion of the property-based hotel project shall not be higher than 10% of the sales area of the project, and the remaining 90% must be used for self-held operation.

The fifth is to increase the number of years that limit the transfer of existing houses. Newly-built commercial houses newly purchased by enterprises, institutions, social organizations and other legal entities must be transferred after 5 years of registration of real estate rights.

The sixth is to further implement differentiated loan policies. The down payment ratio of the second home loan increased to more than 70% for households whose house purchase loans have not been settled.

The seventh is to strengthen the rectification of transactions and the management of prices. Strictly implement the price control system of “one house and one price”, strengthen the price filing management, strengthen the transaction qualification and transaction behavior review, and strictly control the market.

Eighth, the shantytown renovation project and talent purchase will be regulated by separate policies.

It is reported that this “detailed rules” aims to further implement the requirements and spirit of the state, provincial Party committee and provincial government on ensuring the healthy development of the real estate industry, support reasonable housing demand, and curb speculative house purchase, promote the steady and healthy development of Haikou real estate market.
