The public prosecution agency accused that the total amount of bribery was 1.803 million yuan, and the property of 4.684 million yuan could not explain the source.
According to the accusation, the defendant Fan Xianhan, while serving as the county magistrate of Huaining county, secretary of the county Party committee, deputy mayor of Anqing city, and director of the public security bureau, took advantage of the facility of power in matters such as project construction and fund allocation, to seek benefits for others, accept the shopping card with a total of RMB 1.678 million and a value of RMB 91280 for 11 people such as Yu, an Omega watch worth 9900 yuan and a panda gold coin worth 24800 yuan. After the crime, the stolen money and stolen goods have been partially recovered.
The public prosecution agency accused Fan Xianhan of accepting bribes from Zhejiang Shangfeng Holding Group Co., Ltd. Yu, the legal representative of the company, asked Fan Xianhan to support the land development project in Huaining and gave it to Fan Xianhan RMB 710000. Wei Moumou, the legal representative of Huaining Shangfeng Real Estate Co., Ltd, asked Fan Xianhan to help in project coordination, planning and other matters, and sent Fan Xianhan RMB 400000 Yuan one after another. In addition, from 2008 to 2015, fan Xianhan received a shopping card worth 70000 yuan from Xiao Moumou and Wang Moumou, general manager of Huaining Shangfeng Cement Co., Ltd. for 14 times.
As for the crime of unidentified source of huge property, the public prosecution agency pointed out that as of the incident, Fan Xianhan and his family had cash, bank deposits, real estate, vehicles, creditor’s rights, financial investment, living expenses and his son’s spending on studying abroad totaled RMB 13.045738 million. After verification, Fan Xianhan’s family’s salary and bonus income were 2.690603 million yuan, indicating that the source income was 1.446 million yuan, the disciplinary income was 2.547 million yuan, and the criminal income was 1.678 million yuan, fan Xianhan family still has 4.684135 million yuan of property, which cannot explain the source.
During the trial, parties of prosecution and defense fully expressed their opinions. The defender said that Yu gave 10000 yuan to Fan Xianhan during his illness and hospitalization in Hangzhou and 40000 yuan to Wu Moumou during the Spring Festival in 2012 and 2013, which were human relations, no matter of asking for entrustment cannot constitute bribery. In the final statement, Fan Xianhan expressed guilty and repentance, and was willing to continue to return the stolen goods.
