The national anthem, like the national flag and national emblem, is a symbol of a country. China enacted the National Flag Law and the National Emblem Law in 1990 and 1991 respectively, but so far there is no special legislation on the national anthem. In real life, the national anthem has not been universally respected and loved. Due to the lack of legal constraints, there are some problems in the society, such as using the national anthem at will and singing the national anthem is not serious. In addition, the National Anthem does not give full play to the educational function of teenagers. In recent years, during the NPC and CPPCC sessions, many NPC deputies and CPPCC members have put forward suggestions and proposals on formulating the National Anthem Law, suggesting to fill in the legislative gaps as soon as possible.

It is understood that although no special national anthem law has been formulated at present, relevant laws, regulations and normative documents have made some regulations on the performance, playing and use of the national anthem. As stipulated in the national flag law, when the flag raising ceremony is held, during the process of raising the national flag, participants should pay tribute to the national flag and can play the national anthem or sing the national anthem. The advertising law stipulates that advertisements shall not be used or the national anthem shall be used in disguise, and the corresponding legal responsibilities of violators shall be clarified.

In December, 2014, the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council issued the “Implementation Opinions on Regulating the etiquette of singing and singing the national anthem”, on the occasion of singing the national anthem, singing etiquette and publicity and education put forward clear requirements.

The implementation opinions stipulate that the national anthem can be sung in the following Ensemble: at the beginning of an important celebration or political public gathering, at the beginning of an official a diplomatic occasion or a major international gathering, when a flag-raising ceremony is held, when major sports competitions begin or Chinese athletes win the championship in international sports events, when they encounter struggle occasions to safeguard the dignity of the motherland, when major public welfare theatrical performances begin, and other important formal occasions. At the same time, it is stipulated that private weddings and funerals, dances, sorties and other recreational activities, commercial activities, non-political festivals, and other occasions that are not suitable for the nature or atmosphere of the activities are not allowed to sing the national anthem.

The implementation opinions also make it clear that criticism and education should be made for the phenomenon of illegally singing the national anthem on inappropriate occasions and causing adverse social impacts, and for the inetiquette behavior when singing the national anthem, correct the serious national anthem and enhance the seriousness and standardization of the national anthem.
