On May 11, 2017, the WTO published the report of the appellate body of China’s anti-dumping measures against the United States (DS471).

The head of the treaty law department of the ministry of commerce said in a statement that the report of the appellate body overturned the conclusion of the expert group and ruled that the abuse of adverse facts by the united states to calculate high anti-dumping rates constituted a universally applicable measure, china welcomes the clarification of relevant WTO rules. However, because the expert group did not make a comprehensive analysis of this measure, the appellate body could not complete the legal analysis of whether the measure violated the WTO rules, and China expressed regret for this. Previously, the panel of experts in this case had ruled that the 13 anti-dumping measures against China by the United States violated WTO rules in terms of target dumping and refusal to give separate tax rates, and the United States did not appeal.

The person in charge pointed out that this case involved many industries such as electromechanical, light industry and Minmetals, with an annual export amount of about 8.4 billion US dollars, involving China’s major trade interests. China hopes that the US side will fulfill the WTO ruling as soon as possible to ensure that Chinese enterprises enjoy a fair and just international trade environment and maintain the stability, seriousness and authority of WTO rules.
